Do-not-call register

As of 1 July 2021, the do-not-call register has disappeared and made way for the opt-in system. From now on, customers must have given permission before they may be called. So for you as an organisation, a number of important things have changed. In this article we walk you through the change in the law, and what it means for your organisation.

When are you allowed to call as an organisation?

In principle, as a company you may no longer simply call. Traditional cold calling has thus come to an end. Organisations with commercial purposes may no longer contact natural persons who are not yet customers without explicit permission. Think of calling consumers or other companies.

This changes if the other party has given permission in advance (opt-in) or if you want to call an existing customer.

In addition, there are a number of conditions under which you can call without permission.

  • The target has previously been a customer of your company, for a minimum of 3 years, and the company is calling about a comparable service or product
  • When your company is conducting market research
  • When, while orienting towards a product or service, the target has not specifically indicated that he/she does not want to be called (opt-out)

 

How can you make sure you get permission from potential targets?

The remaining question is: how do you, as an organisation, make sure you get permission to call? Asking a customer whether they want to be called about new products or offers will not achieve the desired result.

You will therefore have to be creative as a company. Running a prize draw can be the solution for this. When signing up, participants have to leave their telephone number and give permission to be called. That way, as a company, you can still make sure you get permission.

 

The right to object

Even though the do-not-call register has been abolished, customers and potential targets still have the option to opt out of comparable calls. They can invoke “The Right to Object”. If your customers or potential customers invoke this, you as an organisation are obliged to remove all their data from the call list and may no longer call them.

 

What does this mean for the telemarketing sector?

For the telemarketing sector, the do-not-call register does have consequences. However, a different approach is called for. This approach requires a personal touch.
